Parking enforcement
Road Traffic Act parking tickets issued before 30 March 2008
If you received a parking ticket before 30 March 2008, this will come under the rules of the Road Traffic Act 1991. If you think your ticket was issued incorrectly, the standard appeal process shown below should have been followed:
- Write to the Admail address provided on the back of the penalty charge notice (PCN), setting out the grounds for your appeal.
- The standard penalty charge is £60 and must be paid within 28 days. However, as an incentive to pay early, we reduce the charge to £30 if it is paid within 14 days. If your appeal was received no later than 14 days after the PCN was issued, the charge would have been held at £30 while your appeal was being investigated.
- If your appeal was accepted, the PCN would have been be cancelled. If it was rejected, you would have been given a further 14 days to pay the discounted fine of £30. (If you didn’t pay within 14 days the statutory £60 fine would have become payable).
- If you still didn’t pay within 28 days of your appeal decision our parking unit would have contacted the DVLA and issued a ‘Notice to Owner’ to the registered keeper of the vehicle. The Notice to Owner started the formal appeal procedure and included the forms you needed to make a formal representation to the Traffic Penalty Tribunal (England and Wales).
- The Traffic Penalty Tribunal would have investigated your complaint and made an independent decision. If it found in your favour, the PCN would have been cancelled. If not, you would have been asked to pay the full statutory charge of £60 within 35 days.
- If payment was not received within 35 days you would have received a £90 Charge Certificate.
- If the £90 charge was not paid within 14 days the case would have been forwarded for debt registration and the charge increased to £95.
- If the £95 charge was not paid within 21 days a Warrant of Execution would have been issued and forwarded to bailiffs who will recover the debt.
