Section 106 Agreements

In order to help the process of negotiating and completing Section 106 Agreements, some templates have been published below.

These are designed to cover different types of obligation including:

• Where developer contributions are negotiated to mitigate the cumulative impact of development through the ‘tariff’ approach set out in the Planning Obligations and Affordable Housing SPD
• Where other types of bespoke planning obligation are negotiated (including the provision of affordable housing) through what is referred to as a ‘negotiated element’
• Where claw-back mechanisms are negotiated in relation to schemes that are considered through the Market Recovery Scheme, in response to viability issues raised in the negotiation process
