Guidance on writing an operating schedule

As part of the licensing application process you as the applicant are required to prepare an operating schedule or club operating schedule on the measures that you intend putting in place to show how you will comply with the four licensing objectives;

  • the prevention of crime and disorder
  • public safety
  • the prevention of public nuisance
  • the protection of children from harm.

Your licence cannot be the subject of standard conditions but must reflect how your individual premises will promote these licensing objectives having regard to the licensable activities, location and operating times. For example, if your application relates to a restaurant or village hall, the measures or controls that you would be expected to implement could be less than for a large vertical drinking establishment or nightclub.

Any conditions, controls or restrictions that you offer to promote the licensing conditions will be added to your licence or certificate and as such will govern the way in which you manage your licensed premises. However there are instances where words or phrasing used are confusing or unenforceable, if reproduced in those terms.

We have come up with a pool of licensing conditions that may help you in preparing your operating schedule and are intended to provide a range of options that should cover most eventualities. They are not model or standard conditions that will automatically be attached to your licence. Any applicant preparing an operating schedule is at liberty to volunteer any measure that they intend taking to promote the licensing objectives.

Prior to submitting of your application we would recommend that you contact the Police (crime and order), Environmental Health (public nuisance), Fire (public safety) or any other relevant agency to discuss your application and they may suggest any conditions that should be considered, prior to submission as this may reduce the likelihood of a responsible authority such as the Police, Environmental Health or the Fire Authority submitting a representation.
