Designated Public Places Order - Freedom Fields and Tothill Parks

Licensing Committee considered this application on the 15 March 2011 and resolved to approve the implementation of a Designated Public Places Order for both Freedom Fields and Tothill parks.

It is anticipated that the orders will be effective from 1 April 2011, or soon after this date.

The boundary areas are as shown below and include the two tunnels leading under the railway line to Lucas Terrace and Bulmer Road.

On 21 December 2010 the Council's Licensing Committee considered an application submitted by Devon and Cornwall Police and approved a public consultation on whether to grant Designated Public Places Orders (DPPO) to cover Freedom Fields Park and Tothill Park.

Freedom Fields Park has been identified as an area that suffers from disorder or nuisance associated with people drinking alcohol in public. In addition the applicant is concerned that if the order were granted the problem could be displaced to Tothill Park.

If granted, the orders would not result in a complete ban on drinking in the parks but it would enable the police to ask people to stop drinking in order to prevent alcohol-related nuisance and annoyance from taking place. Anyone refusing to comply would be committing an offence and could face arrest and a fine of up to £500.

The Council has sent a letter and questionnaire to every household and business in the areas surrounding both parks. Additional copies of the questionnaire will be made available in the Community Café in Freedom Fields Park, The Mutley and Greenbank Trust office in Armada Street and the Tothill Community Centre.

The public consultation was launched on 6 January 2011 and ended on 4 February 2011.
