Harbour work licences (harbour authorities)

Associated British Ports (ABP), Cattedown Harbour Commission, The Dockyard Port of Plymouth (Queens Harbour Master) and Sutton Harbour Company.

Details

Regulate works within harbours aiming to protect safety and navigation. Some harbour authorities have the power to regulate works within their areas through the issue of harbour works licences.

When is it required?

Works or alteration of areas within the harbour and wider area.

Application process

Appeals procedure

The applicant has the right to appeal to the Secretary of State against a refused licence consent or imposed terms and conditions. This is to be upheld within 28 days of refusal. Copies of the appeal details are to be sent to the harbour authority and they have 28 days to respond.

Consultation process

The harbour authority will consult with all those with a vested interest in the harbour area, such as the MMO, to determine if the proposed activity is likely to have an impact on the European Marine Site or other environmental impact. An advisory committee will also be consulted where necessary.

Course of action under the habitats regulations

All applications of any description will be subject to the requirements of the habitats regulation if they have the potential to impact on the European Marine Site.

This will vary depending on the harbour authority and the nature of the proposal. Contact the appropriate harbour authority for further information.
