Planning consent is needed for any development above the low water mark. Developments below the high water mark will require a marine consent, available from the Marine Management Organisation. If the development lies within the intertidal area between high water and low water mark, then both planning permission and marine consents are required.
For any development above the low water mark (on land). Planning permission required for any development normally covered through the Town and Country Planning General Permitted Development Order (1995) that may significantly effect the environment.
Town and Country Planning Act, 1990
The applicant has the right to appeal against the decision or conditions or lack of decision within a set period under section 78 of Town and Country Planning Act, 1990.
In accordance with Article 10 of Town and Country (General Development Procedures) Order 1995. Local advertisement, neighbour notification, site notices, and consultation with Statutory Bodies.
Notification and consultation with Natural England if the site is or likely to affect European site. There is a judgement on whether the development is likely to have a significant effect on features of European site. If so, an appropriate assessment will need to be undertaken of implications of the development in view of the sites conservation interest.
The aim is for a decision to be reached within eight weeks, or 16 weeks if the proposal is subject to Environmental Impact Assessment.
