Abandoned vehicles

Under the provisions of the Refuse Disposal (Amenity) Act 1978, it is the duty of the local authority to remove any vehicle abandoned in the open air or on any part of the highway. It is also an offence under the Act for any person to abandon such a vehicle, other powers are given through The Road Traffic Regulation Act 1984 and Removal, Storage and Disposal of Vehicles Regulation 1989.

Is it a crime? Yes, under section 2 (1) of the 1978 Act. The maximum penalty for abandoning a vehicle is a fine of £2,500 or 3 months' imprisonment or both

End of Life Vehicle Directive requires all scrap vehicles to be de-polluted before destruction and for a certain percentage of materials to be recovered for reuse.

An abandoned vehicle, generally has the following characteristics:

  • appears to have been left unused on the public highway or open land for a considerable length of time
  • does not have road tax that is in date
  • usually in a poor state of repair and often burnt out, with windows smashed, wheels missing etc

How can I dispose of a vehicle?

If you have a vehicle that you wish to dispose of, Plymouth City Council offer a removal service for a small charge, currently £23.50 (inc. VAT). Caravans can also be disposed at a charge of £50 (inc. VAT). Any vehicles that are disposed of must be free of any rubbish.
