Listed building and conservation area consent

Details
Helps protect the physical evidence of past history, which are valued and protected as a central part of our cultural heritage and sense of identity.
When is it required
For any works for the demolition of a listed building, or for its alteration or extension, which is likely to affect its character as a building of special architectural or historical interest.
Associated legislation
Planning (Listed Building and Conservation Areas) Act, 1990. Proposals affecting a listed building or it’s setting (Section 10). Demolition of buildings within a conservation area (Section 74).
Application process
- An application is submitted with a site plan showing the area as it looks at present.
- A description of the works planned and the effect this may have on the building itself or the setting around the listing.
- Consultations are held to discuss the issues surrounding the application.
- After consultations, the local planning authority will report back to the committee with recommendations.
- A decision is reached whereby a decision notice is issued.
Appeals procedure
Apply to secretary of State under Section 20 of Planning (Listed Buildings and Conservation Areas) Act, 1990.
Consultation process
Consultation is held with English Heritage.
Course of action under the habitat regulations
Demolition may impact on Marine European Site and affect Habitat Regulations.
Timescales
The aim is for a decision to be reached within eight weeks or as agreed with applicant.
